Skylab Technologies Inc. ("Skylab", "we" or "us") recognizes the importance of privacy. The purpose of this privacy statement is to inform you about our privacy practices, including how we collect, use and disclose personal information.
This privacy statement relates to all of our activities, in addition to any separate privacy statement or notice for a particular product, service or activity. This privacy statement does not apply to the extent we process personal information in the role of a processor or service provider on behalf of our customers. In those cases, it is the customer’s privacy practices and policies that apply and we conduct such activities in accordance with our customer’s instructions and pursuant to our contractual arrangements with the customer. If you are an end user or consumer with an existing relationship with one of our customers, you should refer to the customer’s website to understand their privacy practices and policies.

By submitting personal information to us, by registering for or using any of the services we offer, by using our website, or by voluntarily interacting with us, we may collect, use and disclose personal information as set out in this privacy statement.
Skylab offers a film finishing platform, incorporating highly innovative and adaptable technologies and using a collaborative approach with our customers. Skylab services use machine learning and other automated processing to enhance photographs and other images. We are always improving our services to provide better results for our customers and their customers. As part of providing the services, and to continue providing improved services to customers and to their customers, Skylab uses the photographs and other images it processes to improve the machine learning and other automated processing at the core of Skylab software and services. Skylab does not process photographs and other images in a way that identifies individuals who appear in the images or that derives any biometric information from the images.

Meaning of Personal Information
In this privacy statement, "personal information" means information about an identifiable individual. This information may include, but is not limited to, an individual’s name, mailing address, e-mail address, telephone number, photographs and images.
Personal information does not include any business contact information that is solely used to communicate with an individual in relation to their employment, business or profession, such as name, position name or title, work address, work telephone number, work fax number or work electronic address.
Personal information also does not include information where there is no reasonable possibility it can be used to identify an individual, whether on its own or in combination with other information, or Personal Information that has been irreversibly altered such that it cannot identify any individual, either directly or indirectly (“Anonymized Information”).

We collect, use and disclose personal information with consent or as otherwise permitted or required by law. Where required, how we obtain consent (i.e. the form we use) will depend on the circumstances, as well as the sensitivity of the information collected. Subject to applicable laws, consent may be express or implied, depending on the circumstances and the sensitivity of the personal information in question. We may obtain your consent directly or through a third party, for example through our customers who use Skylab services to process images for you.
Typically, we will seek your consent at the time your personal information is collected. Where we want to use your personal information for a purpose not previously identified to you at the time of collection and where required by law, we will seek your consent prior to our use of such information for this new purpose.
Where contemplated under applicable law, you may withdraw your consent to our collection, use or disclosure of your personal information at any time by contacting us using the contact information in the "Contact Us" section below. However, before we implement the withdrawal of consent, we may require proof of your identity. In some cases, withdrawal of your consent may mean that we will no longer be able to provide certain products or services.

Personal Information We Collect
The personal information we collect is generally in one or more of the following categories.
- Products and Services. For individuals who use our products and services, we may collect information from you or from your use of our products or services.
- Information you submit to us: we collect information that you submit through your use of our products or services, including information you provide in connection with the creation and management of your account for our products or services, such as your name, e-mail address and other contact information and password. We also collect information from you that could be associated with you or could identify other individuals such as photographs, images, and graphics. We do not process photographs and other images in a way that identifies you or other individuals who appear in those images, and we do not derive any biometric information from our processing of images.
- Information we automatically collect: We collect log data and usage information relating to your use of our products or services.
- Personal information about other individuals in the course of providing services.
Website. For individuals who visit our website located at www.skylabhq.com or any of our related websites (collectively, "our website"), we may collect information from you or from your activities on the site.
- Like most websites and other Internet services, we may collect certain technical and device information about use of our website. Such information may include Internet protocol address, information about an individual’s device, browser and operating system, and the date and time of your visit.
- We may also use "cookies" or enlist third-party services which use cookies to track preferences and activities on our website. Cookies are small data files transferred to a computer’s hard drive by a website. They keep a record of preferences, making subsequent visits to the site more efficient. Cookies may store a variety of information, including the number of times that an individual accesses a site, registration information, and the number of times that an individual views a particular page or other items on the site. The use of cookies is a common practice adopted by most major sites to better serve their users. Most browsers are designed to accept cookies, but they can be modified to block cookies. Without cookies, some of our website’s functions may not be available.
Information provided by Skylab Customers: We may receive personal information and information that could be associated with you or could identify other individuals such as photographs, images, and graphics from the use of our services by Skylab customers where they submit such information to us. Where we receive personal information from Skylab customers, we generally collect, use, and disclose such personal information on behalf of the Skylab customer who provided the information, and it is the customer’s privacy practices and policies that apply. We may, however, collect images and graphics provided by Skylab customers on our own behalf to improve and develop our products as set out in the section "How We Use Personal Information". Where we collect such photographs, images, and graphics on our own behalf, we will do so with your consent or as otherwise permitted by applicable law. We do not process photographs and other images in a way that identifies you or other individuals who appear in those images, and we do not derive any biometric information from our processing of images.
Other Interactions. For individuals who otherwise interact with us, whether in person, by phone or email, through social media or otherwise, including individuals who might be interested in acquiring our products or services, who sign-up to receive newsletters or other communications, or who respond to surveys and questionnaires, we may collect information provided to us during these interactions. This information may include name, e-mail address and other contact information.
We do not collect payment card information. If you make an online payment using a payment card, such as a credit card or debit card, you are connected directly to our online payment processing service provider and your payment card information is collected and processed by that service provider.
How We Use Personal Information
We may use your personal information and other information for purposes such as:
- to provide our products and services and to support use of our products and services;
- to improve and develop our products and services and our means of automated processing, including to improve, train, and develop the machine learning and other algorithms and models that we use to provide our software and services;
- to contact you relating to our products and services;
- to monitor and improve our products and services, and to develop new products and services;
- to analyze the needs and activities of our customers to help us better serve them;
- to conduct research and analysis related to our business, products and services;
- to respond to inquiries and other requests;
- to collect opinions and comments in regard to our products and services;
- to provide information that we think may be of interest, including in regards to our products and services; and
- to investigate legal claims.
We may use personal information and other information for purposes for which we have obtained your consent, and for such other purposes as may be permitted or required by applicable law.
We do not use the information we collect to provide advertising of third party products and services or targeted advertising of Company products and services across third party websites or service offerings.
We may use images, photographs, and graphics that could identify individuals to build, train, and improve the accuracy of our automated processing (including machine learning and AI). We may also manually review some of the outputs produced by our automated processing against the underlying images or against similar outputs from manual processing. For example, we manually review the output of our automated image processing software and services to improve their output. We do not process photographs and other images in a way that identifies you or other individuals who appear in those images, and we do not derive any biometric information from our processing of images.
We may also anonymize your personal information such that it becomes Anonymized Information. We use Anonymized Information to improve, innovate and develop our services, such as image optimization, texture management, calibration, color integration, and other image processing.
How We Share Personal Information
We rely on third-party service providers to perform a variety of services on our behalf, such as e-commerce providers, payment card processors, telephone and technical support providers, hosting, data storage and processing service providers, and research and analytics providers.
If we provide personal information to service providers, then we require that the service providers maintain the confidentiality of personal information and keep personal information secure. We also require that they only use personal information for the limited purposes for which it is provided. When our service providers no longer need the personal information for those limited purposes, we require that they dispose of the personal information. In some circumstances, we may permit our service providers to retain Anonymized Information that does not identify you. We do not authorize the service providers to disclose your personal information to unauthorized parties or to use personal information for their direct marketing purposes. Additionally, we may use and disclose personal information when we believe such use or disclosure is permitted, necessary or appropriate: (a) under applicable law, including laws outside your country of residence; (b) to comply with legal process; (c) to respond to requests from public and government authorities, including public and government authorities outside Canada; (d) to enforce the terms of the agreements for our products and services; (e) to protect our operations or those of any of our affiliates or subsidiaries; (f) to protect our rights, privacy, safety or property, and/or those of our affiliates, or others; and (g) to allow us to pursue available remedies or limit the damages that we may sustain. In addition, we may transfer personal information and other information to a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer or other disposition of all or any portion of our business, brands, affiliates, subsidiaries or other assets.
If we intend to disclose personal information to a third party for any other purpose, we will identify that third party and the purpose for the disclosure, and obtain consent.

We will use, disclose or retain personal information only for as long as necessary to fulfill the purposes for which that personal information was collected and as permitted or required by law.
Information Security
We have implemented physical, organizational, contractual, and technological security measures with a view to protecting personal information and other information from loss or theft, unauthorized access, disclosure, copying, use, or modification. We have taken steps to ensure that the only personnel who are granted access to personal information are those with a business ‘need-to-know’ or whose duties reasonably require such information.
Despite the measure outlined above, no method of information transmission or information storage is 100% secure or error-free, so we, unfortunately, cannot guarantee absolute security. Accessing and Updating Your Personal Information
We will take steps to ensure that personal information is kept as accurate, complete, and up-to-date as reasonably necessary. We will not routinely update personal information unless such a process is necessary. We expect you, from time to time, to supply us with updates to personal information, when required.
You may make a written request to review any personal information about you that we have collected, used or disclosed, and we will provide you with any such personal information to the extent required by law. You may also challenge the accuracy or completeness of your personal information in our records. If you successfully demonstrate that your personal information in our records is inaccurate or incomplete, we will amend the personal information as required.
We may require that you provide sufficient identification to fulfill your request to access or correct your personal information. Any such identifying information will be used only for this purpose.
International Transfer and Storage of Information
This legal provision outlines the allocation of data processing and storage for Canadian and American entities, facilitated by Amazon Web Services (AWS) and Google Cloud Platform (GCP) as designated cloud providers. It is hereby stipulated that data originating from Canada shall undergo processing exclusively within the Montreal area in the province of Quebec, Canada, utilizing the data processing infrastructure of AWS and GCP situated within that region. Correspondingly, data originating from the United States shall be stored solely within the state of Oregon, United States, utilizing the storage capabilities of both AWS and GCP located in that jurisdiction.
Furthermore, it is acknowledged that data originating from regions outside of North America shall be subject to storage within the United States, incorporating the storage facilities of both AWS and GCP, as per the delineated allocation. This encompassing allocation applies to any data processing required as an integral part of the storage arrangements.
Both parties mutually commit to full compliance with applicable legal and regulatory requirements pertaining to data protection, privacy, and cross-border data transfers. Rigorous security measures shall be implemented to ensure the comprehensive security, confidentiality, and integrity of the processed and stored data, in accordance with the robust security protocols of AWS and GCP.
This prescribed data processing and storage allocation, executed in collaboration with both AWS and GCP, shall remain in effect unless modified by written agreement between the involved parties. Any disputes arising from or connected to this allocation shall be governed by the laws and jurisdiction of the respective country where the data is stored. The parties hereby acknowledge and provide their informed consent to the terms enshrined within this arrangement.

This privacy statement applies only to our products and services. This privacy statement does not extend to any websites or products or services provided by third parties. We do not assume responsibility for the privacy practices of such third parties, and we encourage you to review all third-party privacy policies prior to using third-party websites or products or services.

This privacy statement is current as of the “updated” date which appears at the top of this page. We may modify this privacy statement from time to time. When changes are made to this privacy statement they will become immediately effective when published in a revised privacy statement posted on our website unless otherwise noted.
